Chemung County Executive Files Second Lawsuit Against Legislature Over Attorney

VESTAL, NY (WSKG) - Representatives on the Chemung County Legislature said they have been handed a second lawsuit by County Executive Chris Moss related to the hiring of a legislative attorney.

The Legislature was made aware of the second lawsuit last week. It claims the legislature did not have the authority to amend the county charter to give itself clearer authority over the legislative attorney, Bryan Maggs. That's an action the body took early this year.

An initial lawsuit was filed earlier this year that claimed the county legislature does not have the power to choose its attorney. Moss, who took office in January, had tried to fire Maggs.

“We are extremely disappointed that Moss filed a second lawsuit," Legislative Chairperson David Manchester said in a statement. "Not only does it result in additional unnecessary expenditures of time and taxpayer money, but it is also very disruptive to have one branch of county government repeatedly sue the other."

A call to Moss' office Tuesday morning was not immediately returned.

The issue is expected to be brought up in Chemung County Supreme Court on July 19.
