BINGHAMTON, NY (WSKG) — Whether or not they win the 2020 congressional election, both Democrat Anthony Brindisi and Republican Claudia Tenney plan to run again in 2022.
Brindisi filed his latest election bid for New York’s 22nd Congressional District with the Federal Election Commission on Friday. Tenney filed her candidacy for 2022 in late November of last year.
It is unclear how NY-22 will be impacted by redistricting following the 2020 census.
According to Syracuse.com, Tenney leads Brindisi by 29 votes in the ongoing 2020 election. The final vote count for the race is still up in the air while an Oswego County Supreme Court justice reviews thousands of ballots, leaving NY-22 the only vacant seat in Congress.
A series of disorganization, complications and confusion by the Boards of Elections continuously delayed the case, which began in early November. Justice Scott DelConte, the Oswego County justice presiding over the case, issued a decision in December admonishing the Boards of Elections’ "inadvertent failure to follow the mandate of statute and case law" and ordering partial recounts and corrections to their mistakes as necessary.
On Thursday, lawyers for Tenney notified the court that they filed an appeal of the Dec. 8 decision with the Appellate Division of the New York State Supreme Court.
"The filing by our team simply preserves our right to appeal in the future before the statutory deadline," said Sean Kennedy, a spokesperson for Tenney. "It’s a routine procedural safeguard.”
In New York State, the deadline for filing an appeal of a court decision is 30 days after the judgment was issued. It’s unclear if and when the fourth district appeals court will hear the case.
The race is still too close to call. DelConte is expected to rule on close to 2,500 ballots in the coming days, prompting Boards of Elections to certify their vote counts.
